Your access to and use of the Site is subject to these Terms & Conditions. Use of the Site, whether or not you have created a User Account, indicates your acceptance of these Terms & Conditions. Please read them carefully before using the Site.
1. IMPORTANT NOTICE & DISCLOSURES
(a) Without limiting the Terms & Conditions set out below, we draw your attention to the following matters:
(i) Data Retention: User Data may be retained by the Site for our internal records and validation purposes;
(ii) Data Transfer: User Data of Users who complete an Enquiry will be provided to a Preferred Agent who will then contact the User directly;
(iii) Service Role: MoveNow's obligation ends at providing an Enquiry to an Agent and facilitating the introduction of the Discounted Commission Rate. MoveNow is not a party to the real estate sales appointment;
(iv) Referral Fees: The User acknowledges and consents that MoveNow may receive a referral fee, subscription fee, or marketing fee from the Agent for facilitating this introduction;
(v) Liability: MoveNow is not liable to a User for any act, omission, negligence, or failure to sell by an Agent.
2. DEFINITIONS
In these Terms & Conditions:
(a) Agent or Preferred Agent means a property agent selected by MoveNow who is duly qualified to sell real estate in the relevant state and has agreed to accept the Discounted Commission Rate.
(b) Confidential Information means any information, written or otherwise, in respect of a Property, Intellectual Property, and these Terms.
(c) Discounted Commission Rate means the commission rate advertised on the Site (currently 1.65% including GST]) or such other rate as negotiated between MoveNow and the Agent.
(d) Enquiry means an enquiry by a User seeking an Agent on the terms comprised by the User completing the questions on the Site.
(e) MoveNow means MoveNow Group Pty Ltd ABN 83 111 831 951.
(f) Property means a residential property located in Australia.
(g) Site means the website described as MoveNow located at the domain [www.movenow.com.au].
(h) User means each person or entity that uses the Site.
(i) User Data means any information entered, uploaded, or imported by the User to the Site including names, addresses, and contact details.
3. INTERPRETATION
(a) References to the singular include the plural and vice versa.
(b) A reference to a statute includes all regulations and amendments.
(c) A reference to a monetary amount is to Australian Dollars (AUD).
(d) The laws of Queensland, Australia govern these Terms & Conditions.
4. LICENCE
(a) MoveNow grants to the User a non-exclusive, non-assignable licence to use the Site for its intended purpose and strictly in accordance with these Terms.
(b) The User acquires no rights in the Intellectual Property of the Site other than the right to use it.
5. ACCESS & ACCOUNTS
(a) The User is responsible for providing all equipment and internet connections necessary to access the Site.
(b) MoveNow may use cookies to track User access for analytics and marketing.
(c) To submit an Enquiry, a User may be required to create a User Account. The User must be over 18 years of age and the legal owner (or authorised representative) of the Property.
(d) The User is responsible for the security of their username and password.
6. ENQUIRIES & COMMISSION RATE
(a) Submission: The User must complete an Enquiry by following the prompts on the Site.
(b) Matching: MoveNow will assess the Enquiry and provide the details to a Preferred Agent based on the location of the Property.
(c) The 1.65% Offer: MoveNow introduces the User to the Agent on the understanding that the Agent has agreed to the Discounted Commission Rate (1.65%).
(d) User Responsibility: The User acknowledges that:
(i) The legal agreement to sell the property is between the User and the Agent (not MoveNow);
(ii) The User must verify that the Discounted Commission Rate (1.65%) is correctly written into the official appointment document (e.g., the Property Occupations Form 6 in Queensland or the Agency Agreement in other states) before signing; and
(iii) MoveNow is not liable if a User signs an agreement with an Agent for a higher rate without checking.
7. AGENTS
(a) The Site is a portal for creating connections between Users and Preferred Agents.
(b) No Warranty: MoveNow selects Agents based on their willingness to offer the Discounted Commission Rate. MoveNow makes no warranty about the standard, quality, or success rate of any specific Agent.
(c) Independent Relationship: Any relationship between a User and Agent is strictly between those parties. MoveNow is not involved in the advice, valuation, or representations given by the Agent.
(d) Verification: MoveNow is not liable for verifying the value or saleability of any Property.
8. SYSTEM INTEGRITY & USER CONDUCT
The User must not use the Site to:
(a) Impersonate or misrepresent the User's identity;
(b) Input or transmit material that is defamatory, obscene, misleading, or deceptive;
(c) Breach any intellectual property rights or duty of confidence;
(d) Send spam or unsolicited electronic mail;
(e) Upload viruses, malware, or corrupted files;
(f) Attempt to gain unauthorised access to the Site or its servers;
(g) Collect or store personal data about others without consent; or
(h) Breach the Privacy Act 1988 (Cth).
9. LINKS & ADVERTISING
(a) The Site may contain links to third-party websites. MoveNow is not responsible for the content of those websites.
(b) MoveNow does not endorse any third-party products or services advertised on the Site unless expressly stated.
10. WARRANTIES & DISCLAIMER
(a) "As Is" Basis: To the extent permitted by law, the Site is provided on an "as is" basis without warranty of any kind. (b) Performance: MoveNow does not warrant that the Site will be uninterrupted, virus-free, or error-free. (c) Risk: The User accepts all risks and responsibility for losses, damages, and costs resulting from the User's use of the Site or reliance on an Agent.
11. LIMITATION OF LIABILITY
(a) To the maximum extent permitted by law, MoveNow excludes all liability for any loss or damage (including loss of profits, business interruption, or consequential loss) arising from the use of the Site or the conduct of any Agent. (b) Where liability cannot be excluded by law (e.g., under the Australian Consumer Law), MoveNow's liability is limited to the resupply of the services or the cost of having the services resupplied.
12. INDEMNITY
The User agrees to indemnify and hold harmless MoveNow, its officers, employees, and agents from any claim, liability, loss, or cost (including legal costs) arising from the User's use of the Site, dealings with an Agent, or breach of these Terms.
13. INTELLECTUAL PROPERTY
(a) MoveNow owns all Intellectual Property in the Site.
(b) The User must not assert any right over such Intellectual Property or reverse engineer, copy, or distribute any part of the Site.
14. PRIVACY & DATA USAGE
(a) MoveNow is committed to protecting User privacy in accordance with the Australian Privacy Principles.
(b) Consent to Transfer: By submitting an Enquiry, the User explicitly consents to MoveNow providing their User Data (including name, phone number, email, and property address) to the selected Preferred Agent for the purpose of a real estate appraisal.
(c) Use of Data: The User authorises MoveNow to use User Data to:
(i) Facilitate the introduction to the Agent;
(ii) Verify with the Agent if the property was sold, for the purpose of validating MoveNow's referral/marketing fees; and
(iii) Send administrative updates or marketing materials to the User (the User may opt-out of marketing at any time).
(d) MoveNow will not sell Personal Information to unrelated third parties for merely commercial gain, other than as required for the operation of the Site's service.
15. TERMINATION
(a) MoveNow may terminate a User's access to the Site immediately if the User breaches these Terms.
(b) Upon termination, the User must cease using the Site.
16. GENERAL PROVISIONS
(a) Amendment: MoveNow may amend these Terms & Conditions at any time. Continued use of the Site constitutes acceptance of the amendments.
(b) Entire Agreement: These Terms constitute the entire agreement between the parties regarding the Site.
(c) Severability: If any provision is invalid, it will be removed to the extent necessary without affecting the remaining provisions.
(d) Waiver: No waiver of a breach is binding unless in writing.
(e) Notice: Notices may be served by email or by publication on the Site.
